02. Civil Rights

Wrongful Arrest

The 4th Amendment of the United States Constitution guarantees individuals the right to be free from unreasonable seizures (arrests) and that warrants will not issue unless based upon probable cause that a crime has been committed. If you have been arrested without cause, you may have a federal civil rights action.

Wrongful Removals of Children

When DCS takes a child into foster care, it is a seizure as understood by the 4th amendment. If there was not an emergency or a court order authorizing the removal your child may have a federal civil rights claim and you may have a claim for denial of due process because the constitution guarantees that you, as a parent, as well are your children are entitled to a hearing before a judge before DCS can remove the child.
