Every lawyer, judge, juror, clerk and litigant comes to the courtroom with a lifetime of knowledge and experience. A trial lawyer thinks about these people, the jury instructions, the closing argument, and the evidence before the case is ever accepted by the firm. A litigation attorney starts from the beginning and thinks about the complaint, the discovery, and the settlement conference. Both end up in the courtroom eventually, but that is where the similarities end. I like to think that we trial attorneys are the cool kids, always on the hunt for a win or at least a good fight.
